  47. 1. DEFINITIONS
  48.  
  49. "jv16 PowerTools" means the jv16 PowerTools software product
  50.   and everything included in its official distribution
  51.   packages, such as the documentation, all the plug-in
  52.   applications and all the other such modules and applications.
  53.  
  54. "Trial version" means the free, unlicensed and time limited 
  55.   edition of jv16 PowerTools that can freely be downloaded 
  56.   from Macecraft Software's official web site (www.macecraft.com).
  57.  
  58. "official distribution package" means a package file, such as .zip or
  59.   .rar archive or a self extracting ("SFX") version of such archive, or
  60.   an installation program containing jv16 PowerTools which can be
  61.   downloaded from Macecraft Software's official home page www.macecraft.com.
  62.  
  63. "license agreement" means this text document. This license agreement is a
  64.   legal agreement between you (individual or a legal entity) and
  65.   Macecraft Software. You must accept all the terms in this license 
  66.   agreement and the limitations of your current license if you want 
  67.   to use, run, copy or distribute jv16 PowerTools in any ways.
  68.  
  69. "license" means a legal right to use jv16 PowerTools. A license
  70.   must be bought before you are allowed to use jv16 PowerTools more than
  71.   its trial period of 30 days.
  72.  
  73. "Amount of computers this product can be used with" means all kinds of use,
  74.   such as usage over a network connection or usage from a cd-rom or other
  75.   such media with or without actually installing the software to the specific
  76.   computer(s).

  79. 2. WARNING
  80.  
  81. jv16 PowerTools is protected by copyright laws and international
  82. copyright treaties as well as other intellectual property laws and
  83. treaties. Unauthorized reproduction or distribution of the
  84. jv16 PowerTools, or any portion of it, may result in severe criminal
  85. and civil penalties, and will be prosecuted to the maximum extent
  86. possible under law.

  90. 3. OWNERSHIP
  91.  
  92. jv16 PowerTools is proprietary to Macecraft Software.
  93. The product is licensed, not sold, to you
  94. notwithstanding any reference herein to "purchases".
  95.    
  96. You acknowledge and agree that: 
  97. 1. jv16 PowerTools is protected under U.S. copyright and other laws.
  98. 2. Macecraft Software and its licensors retain all copyrights 
  99.    and other intellectual property rights in the jv16 PowerTools.
  100. 3. There are no implied licenses under this License, 
  101.    and any rights not expressly granted to you hereunder are 
  102.    reserved by Macecraft Software.
  103. 4. You acquire no ownership or other interest
  104.    (other than your license rights) in or to jv16 PowerTools. 
  105. 5. Macecraft Software owns all copies of the jv16 PowerTools, however made.  
  106.  
  107. You agree that you will not, at any time, contest anywhere in 
  108. the world Macecraft Software's ownership of the jv16 PowerTools,
  109. nor will you challenge the validity of Macecraft Software's rights 
  110. in the jv16 PowerTools. You have no rights hereunder to use any
  111. trademark or service mark belonging to Macecraft Software.

  115. 4. GRANT OF LICENSE
  116.  
  117. Macecraft Software is only willing to grant you these rights 
  118. if you obtained jv16 PowerTools from Macecraft Software or a 
  119. Macecraft Software authorized reseller. If you obtained jv16 PowerTools 
  120. from any other source you may not install or use the jv16 PowerTools.
  121.  
  122. Macecraft Software grants you the following rights provided that you
  123. comply with all terms and conditions of this License Agreement:
  124.  
  125.   1. Usage. You may install, use, access and run jv16 PowerTools
  126.      in so many computers that the license you own allows you to.
  127.  
  128.      Note:
  129.      If you don't know with how many computers your current license 
  130.      allows you to use jv16 PowerTools you can find that out by starting
  131.      jv16 PowerTools and pressing the F2 key from your keyboard.
  132.  
  133.   2. Personal usage. If you, or the company you work for, owns a License 
  134.      for jv16 PowerTools you may, in that case, install, use, 
  135.      access and run jv16 PowerTools in your home computer under the 
  136.      same license. In such case, your home computer must be owned and 
  137.      used only by you or the members of your family.
  138.  
  139.   3. Privacy. Macecraft Software hasn't implemented any mechanism, protocol,
  140.      method or algorithm ("Spyware") to jv16 PowerTools which would collect 
  141.      sensitive information from your computer and then would automatically 
  142.      send the information to  Macecraft Software without your knowledge or 
  143.      permission.
  144.  
  145.   4. Basic security. Macecraft Software hasn't implemented any mechanism, 
  146.      protocol, method or algorithm ("Trojan Horse") which would allow
  147.      Macecraft Software to take full control of your computer without 
  148.      your knowledge or permission.

  151.  
  152. 5. RESTRICTIONS AND LIMITATIONS OF USE
  153.  
  154. You are NOT allowed to:
  155.  
  156.   1. Modify, reverse engineer, decompile, disassemble or otherwise
  157.      attempt to reconstruct or discover the source code, or any parts
  158.      of it, or discover or reconstruct any mechanism, algorithm or
  159.      a protocol from the binaries of jv16 PowerTools.
  160.  
  161.   2. Reverse engineer or otherwise attempt to reconstruct or 
  162.      discover the source code, or any parts of it, or discover 
  163.      or reconstruct any mechanism, algorithm or a protocol from 
  164.      the jv16 PowerTools by running any kind of special
  165.      monitoring software, such as registry monitoring software, 
  166.      or analysing software, such as "SoftICE" or other such tool.
  167.  
  168.   3. Create, develop, distribute, use, install or store in your
  169.      computer a program, source code, mechanism, method, protocol or
  170.      algorithm to bypass or to brake jv16 PowerTools' security
  171.      features, license validation, license creation, user account
  172.      validation or user account creation routines, methods or algorithms,
  173.      or any parts of them.
  174.  
  175.   4. Create derivative works based on jv16 PowerTools (e.g. incorporate
  176.      jv16 PowerTools in a commercial product or service without a proper
  177.      license), except that you may create bug fixes and translations.
  178.  
  179.   5. Rent, lease, sublicense, convey, distribute or otherwise
  180.      transfer rights to jv16 PowerTools without a written permission
  181.      from Macecraft Software.
  182.  
  183.   6. Remove any product identification, copyright, proprietary
  184.      notices or labels from jv16 PowerTools.
  185.  
  186.   7. Distribute, re-distribute, rent, lease or sell the licensed
  187.      version of jv16 PowerTools or any portions of it or the license
  188.      itself, the "license.dat" file, or any portions of the 
  189.      license or the "license.dat" file without a written permission
  190.      from Macecraft Software.
  191.  
  192.   8. Sell, re-sell, rent or lease jv16 PowerTools, any portions of it 
  193.      or its license, or any portions  of a license without written
  194.      permission from Macecraft Software.
  195.  
  196.   9. Distribute jv16 PowerTools in any other form than in the
  197.      official distribution packages without a written permission
  198.      from Macecraft Software.
  199.  
  200.   10. Use the licensed version of jv16 PowerTools if you do not
  201.       have a valid license or if you do not know who has bought the 
  202.       license or if you know that the copy you are using is illegal 
  203.       or the license itself is illegal or faked.
  204.  
  205.   11. Use, run, copy, distribute or store jv16 PowerTools in your computer
  206.       if this license agreement is violated in any ways.

  210. 6. TERMINATION OF LICENSE
  211.  
  212. Macecraft Software has the right to terminate this license if you do
  213. not abide by the terms and conditions of this license, in which case 
  214. you must destroy all copies of jv16 PowerTools and all of its 
  215. component parts.
  216.  
  217.  
  218. 7. MAINTENANCE, SUPPORT AND UPDATES
  219.  
  220. Macecraft Software is under no obligation to maintain, support or
  221. update jv16 PowerTools in any ways, or to provide updates or error
  222. corrections.
  223.  
  224. However, if you have purchased technical support from Macecraft Software
  225. for this product will Macecraft Software then provide technical assistance 
  226. according to the terms of the contract.
  227.  
  228.  
  229. 8. CONFIDENTIALITY
  230.  
  231. Licensed version of jv16 PowerTools and any license authorization
  232. codes (such as the "license.dat" file) are confidential. You agree to take
  233. adequate steps to protect jv16 PowerTools and any license authorization
  234. codes and "license.dat" file from unauthorized disclosure or use.
  235. You agree that you will not disclose the licensed version of
  236. jv16 PowerTools, any parts of it, its license or any parts of the
  237. license to any third party.

  240. 9. DISCLAIMER
  241.  
  242. Macecraft Software expressly disclaims all warranties, whether express, 
  243. implied or statutory, including, without limitation, the implied 
  244. warranties of merchantability, of fitness for a particular purpose, 
  245. noninfringement of third party intellectual property rights, and any 
  246. warranty that may arise by reason of trade usage, custom, or course of 
  247. dealing. Without limiting the foregoing, you acknowledge that 
  248. jv16 PowerTools is provided "as is" and that Macecraft Software 
  249. does not warrant that jv16 PowerTools will run uninterrupted or error 
  250. free nor that jv16 PowerTools will operate with hardware and/or 
  251. software not provided by Macecraft Software. This disclaimer
  252. of warranty constitutes an essential part of the agreement. Some states
  253. do not allow the exclusion of implied  warranties, so the above exclusion
  254. may not apply to you, and you may have other rights, which vary from
  255. state to state.

  258. 10. LIMITED LIABILITY
  259.  
  260. The entire risk as to results and performance of jv16 PowerTools is assumed
  261. by you. Under no circumstances will Macecraft Software or they licensors be liable
  262. for any direct or special, indirect, incidental, exemplary or consequential
  263. damages of any kind or nature whatsoever, whether based on contract,
  264. warranty, tort (including negligence), strict liability or otherwise,
  265. arising out of or in any way related to jv16 PowerTools or this agreement,
  266. even if the Author or his licensors have been advised of the possibility
  267. of such damage or if such damage could have been reasonably foreseen,
  268. and notwithstanding any failure of essential purpose of any exclusive
  269. remedy provided in this agreement. Such limitation on damages includes,
  270. but is not limited to, damages for loss of goodwill, lost profits, loss
  271. of data or software, work stoppage, computer failure or malfunction or
  272. impairment of other goods. In no event will the Author or his licensors
  273. be liable for the costs of procurement of substitute Software or services.
  274. in addition, in no event will the total liability of the Author in connection
  275. with this agreement or jv16 PowerTools exceed the actual amount paid to the
  276. author, if any, for jv16 PowerTools giving rise to the claim. You acknowledge
  277. that jv16 PowerTools is not designed or licensed for use in on-line equipment
  278. in hazardous environments such as operation of nuclear facilities, aircraft
  279. navigation or control, or life-critical applications. The Author expressly
  280. disclaims any liability resulting from use of jv16 PowerTools in any such
  281. on-line equipment in hazardous environments and accepts no liability in
  282. respect of any actions or claims based on the use of jv16 PowerTools in any
  283. such on-line equipment in hazardous environments by you. For purposes of
  284. this paragraph, the term "life-critical application" means an application
  285. in which the functioning or malfunctioning of jv16 PowerTools may result directly
  286. or indirectly in physical injury or loss of human life.

  289. 11. DISTRIBUTING
  290.  
  291. Trial version of jv16 PowerTools may be freely distributed provided
  292. that it is not modified in any ways and that the original distribution packages
  293. remain intact with all accompanying files, and provided that no fee is
  294. charged (except for any reasonable fees necessary to cover costs of
  295. distribution media), and that this license agreement is not violated
  296. in any ways. You are not allowed to include jv16 PowerTools to any
  297. commercial CD-ROM or DVD software collection without a written permission
  298. from Macecraft Software.
  299. Macecraft Software reserves the right to deny you from distributing
  300. jv16 PowerTools even if you haven't violated this license agreement.

  303. 12. RESERVATION OF RIGHTS
  304.  
  305. Macecraft Software reserves all rights not expressly granted to you 
  306. in this license agreement.

  309. YOU AGREE TO BE BOUND BY THE TERMS OF THIS LICENSE
  310. AGREEMENT AND THE LIMITATIONS OF YOUR LICENSE
  311. BY INSTALLING, COPYING, DISTRIBUTING OR OTHERWISE
  312. USING JV16 POWERTOOLS. IF YOU DO NOT AGREE, DO NOT
  313. INSTALL, DISTRIBUTE OR USE JV16 POWERTOOLS IN ANY WAYS.
